In Colombia, acts of discrimination are punishable with up to three years in prison, though judges can replace prison time with parole or house arrest.<\/p>\n<p class=\"Component-root-0-2-56 p Component-p-0-2-47\">The small business owner from Bogota went viral in September after she railed against Vice President Francia M\u00e1rquez on a video published by a local news site. Rubiano was protesting in front of Colombia\u2019s congress and responded to a question from a journalist by hurling insults against M\u00e1rquez and Afro-Colombians.<\/p>\n<p class=\"Component-root-0-2-56 p Component-p-0-2-47\">\u201cApes are now governing us,\u201d Rubiano said in the video, which is still available on Twitter, but was censored by other platforms. \u201cFrancia M\u00e1rquez is an ape \u2026 what education can Black people have, they steal, attack and kill.\u201d<\/p>\n<div class=\"Component-dfp-0-2-51 apnews_article_midarticle_1\" data-card-id=\"sovrn-article-midarticle\">\n<p class=\"Component-root-0-2-56 p Component-p-0-2-47\">Prosecutors launched an investigation after Marquez\u2019s lawyers filed a complaint.<\/p>\n<p class=\"Component-root-0-2-56 p Component-p-0-2-47\">During a hearing, they accused Rubiano of inciting hate, and damaging the reputation of M\u00e1rquez and Colombia\u2019s Afro-Colombian population, while compromising their right to not be discriminated against.<\/p>\n<p class=\"Component-root-0-2-56 p Component-p-0-2-47\">Marquez became Colombia\u2019s first Black vice president last year after helping leftist Gustavo Petro win the presidential election.
